10.3 36earnphp's total aggregate liability to you for any claim arising under these Terms shall not exceed the total amount deposited by you into your 36earnphp account in the thirty (30) days preceding the event giving rise to the claim.
10.4 Nothing in these Terms shall limit or exclude liability for fraud, gross negligence, or any other liability that cannot be excluded under applicable Philippine law.
11.1 By 36earnphp. 36earnphp reserves the right to suspend or permanently close your account at any time, with or without prior notice, if: (a) you breach any provision of these Terms; (b) 36earnphp is required to do so by law or regulatory directive; (c) 36earnphp reasonably suspects fraudulent, abusive, or criminal activity; or (d) your account has been inactive for an extended period as defined in the Platform's dormant account policy.
11.2 By You. You may close your 36earnphp account at any time by contacting our support team. Upon closure, any remaining real-money balance (excluding bonus funds that have not met wagering requirements) will be returned to you via your registered payment method, subject to completion of any outstanding KYC verification.
11.3 Effect of Termination. Upon termination of your account for any reason, your licence to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination — including Sections 8, 9, 10, and 12 — shall continue to apply.
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
